What it does
The Workers' Compensation and Rehabilitation Act 2003 (Qld) establishes Queensland's workers' compensation scheme. Section 5 records that the scheme provides compensation, regulates access to damages, sets employers' liability for compensation, mandates employer cover under either a WorkCover policy or a self-insurer licence, and requires injury management with rehabilitation focused on return to work. Section 6 names the administrators: the Workers' Compensation Regulator and WorkCover Queensland.
The Act binds all persons including the State (section 3). Its objects in section 5(4) call for a balance between fair benefits for injured workers and reasonable cost levels for employers, fair treatment by insurers, protection of employer interests in damages claims, return-to-work programs, anti-discrimination protection for prospective workers who have sustained an injury under the Act or a former Act, and flexible insurance arrangements.
