### sec.154 Total incapacity—workers receiving certain benefits under Commonwealth law
This section applies if a totally incapacitated worker was receiving an age, disability support or class B widow pension under a Commonwealth law when the injury was sustained.
The compensation payable to the worker is the lesser of the following amounts—
the amount the worker was earning at the time of the injury;
the amount the worker is entitled to earn before the maximum pension payable to the worker is reduced.
(sec.154-ssec.1) This section applies if a totally incapacitated worker was receiving an age, disability support or class B widow pension under a Commonwealth law when the injury was sustained.
(sec.154-ssec.2) The compensation payable to the worker is the lesser of the following amounts— the amount the worker was earning at the time of the injury; the amount the worker is entitled to earn before the maximum pension payable to the worker is reduced.
- (a) the amount the worker was earning at the time of the injury;
- (b) the amount the worker is entitled to earn before the maximum pension payable to the worker is reduced.
