### sec.162 Definitions for sdiv 1
In this subdivision—
LE means the worker’s or person’s loss of earnings, expressed as a weekly rate, because of the injury.
loss of earnings means the difference between—
the amount of the worker’s or person’s normal weekly earnings at the time of injury; and
the amount—
of the worker’s or person’s weekly earnings from employment during the period of partial incapacity; or
if the worker or person is not in employment during the period of partial incapacity—that could be reasonably expected to be derived by the worker or person during the period, having regard to the worker’s or person’s incapacity and the availability of employment.
MC means the maximum compensation expressed as a weekly rate, that would have been payable under this part had total incapacity of the worker or person resulted from the injury.
NWE see section 106 .
PC means the compensation expressed as a weekly rate, payable for the injury on account of the partial incapacity.
- (a) the amount of the worker’s or person’s normal weekly earnings at the time of injury; and
- (b) the amount— (i) of the worker’s or person’s weekly earnings from employment during the period of partial incapacity; or (ii) if the worker or person is not in employment during the period of partial incapacity—that could be reasonably expected to be derived by the worker or person during the period, having regard to the worker’s or person’s incapacity and the availability of employment.
- (i) of the worker’s or person’s weekly earnings from employment during the period of partial incapacity; or
- (ii) if the worker or person is not in employment during the period of partial incapacity—that could be reasonably expected to be derived by the worker or person during the period, having regard to the worker’s or person’s incapacity and the availability of employment.
- (i) of the worker’s or person’s weekly earnings from employment during the period of partial incapacity; or
- (ii) if the worker or person is not in employment during the period of partial incapacity—that could be reasonably expected to be derived by the worker or person during the period, having regard to the worker’s or person’s incapacity and the availability of employment.
