What it does
The Magistrates Court Act 1930 (the Act) is the foundational statute governing the Magistrates Court of the Australian Capital Territory (ACT). As republished effective 26 November 2025 (Republication No 104, last amended by A2025-29), it continues the Court (s 4(1)), delineates its constitution and the appointment and jurisdiction of magistrates (Chapter 2), and prescribes comprehensive procedures for criminal proceedings (Chapter 3), civil proceedings (Chapter 4), and specialist jurisdictions including the Childrens Court (Chapter 4A), Family Violence Court (Chapter 4B), Galambany Court (Chapter 4C), and Industrial Court (Chapter 4D).
In substance, the Act performs four core functions. First, it establishes the institutional framework. The Court is constituted by a magistrate (other than a special magistrate) or one or more special magistrates (s 4(2)). The Chief Magistrate arranges business (s 5) and may assign magistrates (s 5(2)). Appointment criteria for magistrates are determined by notifiable instrument (s 7AA), with eligibility limited to lawyers of at least five years' standing (s 7A). Magistrates retire at 70 (s 7D), must not practise law or undertake incompatible work without consent (s 7G), and enjoy the same protection and immunity as Supreme Court judges (s 17A(1)).
Second, the Act codifies criminal jurisdiction and process. The Court has summary jurisdiction over offences punishable summarily (s 19) and may deal with indictable offences in defined circumstances (Part 3.5). Proceedings commence by information (s 25), court attendance notice (s 41B), or warrant (s 42). Pre-committal disclosure is mandatory (s 90), with strict rules on non-disclosure of addresses (s 90AAA) and sanctions for non-compliance (s 108AG in the parallel summary regime). Committal occurs where there is a reasonable prospect of conviction (s 94(1)(b)). The Act integrates infringement notices for prescribed offences (Part 3.8), allowing discharge by payment (s 125) or management plans (s 131AA), with vehicle-related variants (Division 3.8.3) permitting declarations as to users (ss 131D–131G).
