264 Proceedings affecting title to land
(1) The Magistrates Court does not have jurisdiction to hear and decide
a proceeding in which the title to land is genuinely in question.
(2) However, the jurisdiction of the Magistrates Court to hear and decide
a proceeding is not affected only because the title to land incidentally
comes in question in the proceeding.
(3) In a proceeding mentioned in subsection (2), a judgment is not
evidence of title to land.
