116E Procedure if plea of guilty entered
(a) a defendant enters a plea of guilty in accordance with
section 116D; and
(b) the defendant—
(i) does not appear at the hearing; or
(ii) appears but does not withdraw his or her plea of guilty; and
(c) the court accepts the plea of guilty;
the court must record a plea of guilty and decide the proceeding
(2) The court, in deciding a proceeding under subsection (1), must have
regard to any matter drawn to its attention in the plea of guilty and
give the matter the weight it considers appropriate.
(3) If the court declines to accept a plea of guilty entered in accordance
with section 116D—
(a) the court must adjourn the hearing and fix a time and place for
the hearing of the proceeding; and
(b) if the defendant is not before the court—the registrar must give
to the defendant notice of the time and place fixed.
(4) If a defendant does not appear at the time and place fixed under
subsection (3), the court may hear and decide the proceeding in the
absence of the defendant.
