8A Term of appointment of special magistrates
(1) A special magistrate is appointed—
(a) for the term mentioned in the instrument of appointment; or
(b) if a term is not mentioned—for the term ending when the special
magistrate turns 70 years old.
Note 1 The Judicial Commissions Act 1994, s 4 provides that a magistrate may
only be removed from office in accordance with that Act.
Note 2 A special magistrate’s appointment also ends if the special magistrate
resigns (see Legislation Act, s 210).
(2) A person who is at least 70 years old must not be appointed as a
special magistrate.
(3) A person must not be appointed as a special magistrate for a term that
extends beyond the person’s 70th birthday.
