97 Discontinued proceeding
If—
(a) in a proceeding under this part, the court is of the opinion,
having regard to all the evidence before it, that there is no
reasonable prospect that the person would be convicted of an
indictable offence; or
(b) a proceeding under this part is discontinued for any other reason;
the court may order that the informant pay to the defendant the costs
the court considers just.

103 Recognisance of witnesses etc
(1) The court may bind by recognisance every person whose written
statement was admitted in evidence under section 90AA, or who was
examined before it, to appear at the court at which the defendant is to
be tried, and then and there to give evidence against the defendant.
(2) The recognisance must particularly specify the profession, trade, or
calling of every person who enters into it, together with the person’s
full name and place of residence.
