317 Record of proceedings and transcript
(1) If a record made by means of recording apparatus, shorthand or
similar means is produced out of the custody of the registrar and the
record purports to be a record made in accordance with
section 316 (2) of the depositions of a witness in any proceeding, the
record is evidence that the person made the depositions in the
(a) a recording is produced out of the custody of the registrar; and
(b) the recording contains a record of comments that purport—
(i) to have been made at the same time as a recording made in
accordance with section 316 (2) of the depositions of a
person in any proceeding; and
(ii) to have been made for the purpose of identifying the
proceeding, voices recorded on the lastmentioned
recording or anything else so recorded;
the firstmentioned recording is evidence of the identity of the
proceeding, of the voices or of the thing.
(3) If—
(a) a document purports to be a transcript, or a copy of a transcript,
of a record made in accordance with section 316 (2) of
depositions made by a person in any proceeding; and
(b) the document bears a certificate that purports to be a certificate
given in accordance with section 314 (2) or section 315 (5);
the document is evidence that the person made the depositions in the

(a) purports to be the depositions of a witness in any proceeding as
taken down in writing and signed in accordance with
section 316 (3); or
(b) purports to be a copy of the depositions of a witness in any
proceeding as so taken down in writing and signed and bears a
certificate that purports to be a certificate given in accordance
with section 315 (5);
the document is evidence that the witness made the depositions in the
recording apparatus means the recording apparatus, whether
audiovisual or sound, by means of which a record of depositions of
witnesses has been made under section 316 (2).
