22 Proceeding of court if it considers offence should be
dealt with on indictment
If, for an information in relation to an offence that is punishable either
summarily or on indictment it appears to the court, on the close of the
case for the prosecution, that the offence ought to be dealt with on
indictment, the court must abstain from adjudication on the
information and must deal with the case for the purpose of committal
for trial only.
