(sec.91-ssec.4) Despite subsection (2) (b) , a person may use a relevant boat in the regulated waters if the person ensures the conditions mentioned in the Fisheries (Commercial Fisheries) Regulation 2019 , section 79 (2) have been complied with.
This section applies if, in the reef world heritage area, on a particular day (the base day ) in a particular effort year (the base year ), the following total entitlements under all effort units for all trawl regions are used— for the effort year starting at midday on 1 January 2026—1,959,596; for the effort year starting at midday on 1 January 2027—1,940,000; for the effort year starting at midday on 1 January 2028—1,920,600; for the effort year starting at midday on 1 January 2029—1,901,394. A person must not in the reef world heritage area— possess or use a trawl net under a primary commercial fishing licence for the east coast trawl fishery in the regulated period; or possess a fish taken in a way that contravenes paragraph (a) . For subsection (2) , the regulated period starts on the day that is 5 days after the base day and ends at midday on 1 January in the year after the base year. If the total entitlement is used on a Monday, the regulated period starts on the next Saturday and ends at midday on 1 January in the next year. See the Fisheries (Commercial Fisheries) Regulation 2019 , section 72 for the requirement for the chief executive to give usage notices to holders of primary commercial fishing licences for the east coast trawl fishery about the usage of entitlements and section 73 for the holders’ obligations under usage notices. s 92 amd 2019 SL No. 181 ss 16 , 27 sch 1 ; 2020 SL No. 236 s 178 sub 2021 SL No. 162 s 8 amd 2025 SL No. 4 s 6 (sec.92-ssec.1) This section applies if, in the reef world heritage area, on a particular day (the base day ) in a particular effort year (the base year ), the following total entitlements under all effort units for all trawl regions are used— for the effort year starting at midday on 1 January 2026—1,959,596; for the effort year starting at midday on 1 January 2027—1,940,000; for the effort year starting at midday on 1 January 2028—1,920,600; for the effort year starting at midday on 1 January 2029—1,901,394. Why it matters (stated purpose and how the instrument operates against that purpose)
The instrument implements geographically and temporally tailored controls to manage fishing pressure on species and habitats. For example, certain waters are closed to taking particular species, or possession of those species on boats is restricted during stated periods (secs 13–38, 20–21, 23, 27A–27D, 35–37, 51–53).
It also creates effort‑responsive safeguards: several closures trigger when a numeric threshold of "effort units" is reached and when the chief executive publishes a usage notice (secs 86AA, 86B, 86C, 86D, 86E, 86BA, 86C). Mechanically, that means closures can be short‑term and data‑driven rather than only fixed calendar closures.
The instrument balances prohibitions with numerous exceptions: licensed commercial fishers, holders of specific units (line units, SM units, effort units), holders of particular licences and recreational fishers on qualifying charter trips can, under rules, possess or take fish that otherwise would be prohibited (for examples, see secs 15–16, 19, 22, 24–25, 117–119, 121A).
Costs, incentives and trade‑offs (mechanisms, not value judgments)
Compliance costs for users: fishers must follow many technical constraints (gear dimensions, mesh sizes, number limits, marking/tagging in English, stowing and securing requirements) — eg. gear marking/tag requirement (secs 150, 157), stowed and secured rules for trawl nets (sec.98), detailed net specs in dugong areas and Wellesley Islands (secs 64, 66, 69–78).
Operational constraints for commercial operators: gear bans, seasonal closures and vessel‑use limits (eg. primary boat limits for T1/T2 licences if thresholds hit — sec.86BA; restricted days/months for T1/T2 use — sec.93) reduce the hours or places commercial fishers can operate, and create incentives to shift effort in time, gear or location.
Dynamic (effort‑triggered) management provides an incentive for licence‑holders to monitor and potentially limit their reported effort to avoid triggering closures. It also creates a practical need for accurate, timely usage reporting and for the department to collect and act on effort data (see secs 86AA, 86B, 86C, 86D, 86E, 92).
Substitution effects are possible: prohibiting a gear or area can shift fishing pressure onto other gears, areas, species or times. The instrument contains many targeted rules rather than a single statewide approach (see many area‑ and species‑specific provisions across parts 3–12).
Concentrated benefits and diffuse costs: specific closures or exemptions (eg. access for holders of particular units, permitted commercial landing places — secs 25, 27G, 121A) produce identifiable advantages for some commercial licence holders, while many recreational users face smaller, scattered restrictions (examples throughout ch.2 & ch.4).
Bureaucratic discretion, implementation risk and enforcement issues
Chief executive discretion: the chief executive prepares and holds plans, publishes notices that start effort‑based closures, and issues permits. Those administrative acts directly change when and where prohibited activities apply (secs 9, 86AA, 86B, 86C, 86D, 86E, 92, 97, 111). This concentrates operational decision‑making in the department.
Boundary and mapping ambiguity: boundaries are often defined by plans or shorelines; the law says shoreline‑based boundaries are decided by the shoreline as altered and that indicative plans are not incorporated — that creates reliance on updated charts and field judgement for enforcement (sec.11).
Enforcement complexity: the rules are highly specific (gear dimensions, labelling, precise date ranges, licence exceptions, numeric thresholds). That increases the burden on inspectors to check technical compliance (e.g. mesh diameter thresholds, permitted net material, labelling in English, stowed vs deployed status — secs 62, 64, 66, 98, 150–158).

Each of the waters described in schedule 1 , column 2— is declared to be regulated waters; and has the name set out opposite it in column 1 of the schedule. The regulated waters in schedule 1 , part 1 are named by reference to particular fish, the taking or possession of which is regulated in the waters. The regulated waters in schedule 1 , part 2 are— named by reference to their location; and listed in approximate order of their location going from the State’s border with New South Wales to the State’s border with the Northern Territory. To help users of this declaration, indicative plans of particular regulated waters are published on the department’s website. The indicative plans are not applied, adopted or incorporated by this declaration. This section applies for identifying waters that form part of regulated waters that are declared by reference to waters shown as regulated waters on a fisheries regulated waters plan. Waters shown within the boundary lines on the fisheries regulated waters plan are part of the regulated waters. However, if the fisheries regulated waters plan shows that waters within a particular boundary are excluded from the regulated waters shown on the plan, those waters are not part of the regulated waters. If the fisheries regulated waters plan shows a boundary by reference to a geographical feature or fixed structure— the boundary is decided by reference to the feature or structure; and to the extent the boundary is decided by reference to the feature or structure, a line in relation to the boundary shown on the plan is only indicative of the current position of the boundary. Regulated waters are shown on a fisheries regulated waters plan by reference to a shoreline. Rough weather alters the location of parts of the shoreline. The boundary of the regulated waters is decided by reference to the shoreline as altered, despite any inconsistency with the location of the shoreline as shown on the plan. Also, if the fisheries regulated waters plan shows a boundary with a gap in it, the boundary continues in a straight line across the gap to the nearest point of the boundary on the other side of the gap.
