sec.140A Possessing or using crab apparatus
This section applies if— there is more than 1 person on a boat; and the boat is taking part in a licensed charter fishing trip; and the persons on the boat are possessing or using crab apparatus to take spanner crabs. The person conducting the licensed charter fishing trip must ensure— the persons on the boat do not— possess or use more than a total of 20 items of crab apparatus; or fix more than a total of 10 items of crab apparatus to a line; and for an item of crab apparatus that is a dilly—the crab apparatus is marked in a way that complies with the Fisheries (Commercial Fisheries) Regulation 2019 , schedule 7 , section 25 . s 140A ins 2019 SL No. 181 s 21 (sec.140A-ssec.1) This section applies if— there is more than 1 person on a boat; and the boat is taking part in a licensed charter fishing trip; and the persons on the boat are possessing or using crab apparatus to take spanner crabs. (sec.140A-ssec.2) The person conducting the licensed charter fishing trip must ensure— the persons on the boat do not— possess or use more than a total of 20 items of crab apparatus; or fix more than a total of 10 items of crab apparatus to a line; and for an item of crab apparatus that is a dilly—the crab apparatus is marked in a way that complies with the Fisheries (Commercial Fisheries) Regulation 2019 , schedule 7 , section 25 .
- (a) there is more than 1 person on a boat; and
- (b) the boat is taking part in a licensed charter fishing trip; and
- (c) the persons on the boat are possessing or using crab apparatus to take spanner crabs.
- (a) the persons on the boat do not— (i) possess or use more than a total of 20 items of crab apparatus; or (ii) fix more than a total of 10 items of crab apparatus to a line; and
- (i) possess or use more than a total of 20 items of crab apparatus; or
- (ii) fix more than a total of 10 items of crab apparatus to a line; and
- (b) for an item of crab apparatus that is a dilly—the crab apparatus is marked in a way that complies with the Fisheries (Commercial Fisheries) Regulation 2019 , schedule 7 , section 25 .
- (i) possess or use more than a total of 20 items of crab apparatus; or
- (ii) fix more than a total of 10 items of crab apparatus to a line; and
