What it does
The Local Government (General) Regulation 2021 (NSW) is the omnibus subordinate instrument under the Local Government Act 1993 (NSW). It commenced on 1 September 2021, replacing the Local Government (General) Regulation 2005. The Regulation provides the operational rules, forms, standards, and procedures that councils must follow across almost every area of local government administration.
Where the Local Government Act 1993 creates the statutory framework for councils (including their functions, powers, election of councillors, financial management, and community land), this Regulation fills in the details. It prescribes the forms of applications for various approvals; the standards for water, sewerage, and waste services; the tendering thresholds and procedures; the model codes for conduct and meeting practice; the financial reporting and accountability rules; the election procedures; and the penalty notice amounts for a wide range of offences.
The Regulation is structured in 14 Parts (plus additional Parts and Schedules for specific technical standards). The Parts broadly correspond to the major operational domains of council administration.
