396A De-amalgamation referendums—business cases
> > (1) For the Act, Schedule 10, clause 3(e), a business case under the Act, section 218CD(1)(a) must include the following—
> >
> > > (a) a cost benefit analysis of the de-amalgamation proposal, including a description and the quantitative value of the costs and benefits of the proposal,
> >
> > > (b) a summary of the risks of both the proposed de-amalgamation and the continuation of the amalgamated area and details of how the risks will be managed,
> >
> > > (c) a map of the amalgamated area that shows the former areas immediately before the date of amalgamation,
> >
> > > (d) if the proposed de-amalgamation will result in premises or a road being located in more than one area—details of issues arising from the premises or road being located in more than one area,
> >
> > > (e) details of proposed arrangements for each newly constituted area, including the following—
> > >
> > > > (i) who will exercise the functions of the councils of each newly constituted area during the transition period,
> > >
> > > > (ii) the transfer of staff, assets, rights and liabilities of the amalgamated council to the councils of each newly constituted area,
> > >
> > > > (iii) whether instruments or decisions of the amalgamated council, including codes, plans, strategies and policies, will continue in force, and, if not, details of proposed replacement instruments or decisions,
> >
> > > (f) details of the proposed councils of each newly constituted area, including the number of councillors of each council,
> >
> > > (g) if it is proposed that the newly constituted areas be divided into wards, details of the proposed wards including—
> > >
> > > > (i) the number of wards, and
> > >
> > > > (ii) the ward boundaries.

> > (2) In this section—

> > newly constituted area means an area constituted by a de-amalgamation proclamation.

> > transition period means the period—
> >
> > > (a) starting on the day the de-amalgamation proclamation for the proposed de-amalgamation takes effect, and

> > > (b) ending on the day the first councillors are elected to the council of the newly constituted area.
