What it does
The Fisheries Regulations 1992 (NT) are the primary subordinate instrument under the Fisheries Act 1988 (NT). They translate the framework powers in the Act into detailed, operative rules governing who may fish in Northern Territory waters, what equipment they may use, how much they may catch, how their catch must be recorded and sold, and what penalties apply when things go wrong.
The Regulations cover two main groups: commercial operators who fish for profit, and amateur fishers who fish for personal use. For commercial operators, the Regulations declare and administer eight distinct named fisheries, each with its own licensing class, area boundary, gear restrictions, quota unit mechanism, vessel monitoring system (VMS) obligations, and reporting duties. For amateur fishers, they set possession limits, size limits, gear restrictions, and vessel-level possession caps.
The Regulations are in force as at 31 July 2024 and have been substantially amended since 1992, incorporating offshore and demersal fishery regimes, pearl oyster aquaculture provisions, and updated royalty arrangements for Joint Authority fisheries that sit at the boundary between Territory and Commonwealth jurisdiction.
