National Vocational Education and Training Regulator Act 2011

For Courses:

• Courses must be officially accredited (approved) and meet national standards
• Accreditation lasts up to 5 years and can be renewed, amended, or cancelled

For Qualifications:

• ASQA can cancel a qualification or statement of attainment already issued to a student if it was awarded improperly (e.g., assessments weren't actually conducted, the provider wasn't authorised to issue it, or it was obtained fraudulently)
• Using a cancelled qualification as if it were still valid carries a civil penalty of up to 240 penalty units (currently around $75,000 for individuals)

Inspections and Enforcement:

• Authorised officers have powers to enter premises, inspect records, and gather evidence
• ASQA can request documents and information; failing to comply is a criminal offence (up to 150 penalty units)
• Courts can order civil penalties for breaches of key obligations

National Consistency:

• The Act applies nationally through a cooperative arrangement where most states and territories have referred their powers over VET regulation to the Commonwealth (federal government)
• States that haven't referred their powers ('non-referring states') are still covered for organisations that operate across borders or deliver courses to overseas students
• Once registered under this Act, a provider is immune from duplicative state/territory VET laws — you only need to deal with one regulator

Why It Matters

Before this Act, every state had its own VET regulator, creating a patchwork system. This Act created one national regulator to ensure that a Certificate III in Carpentry means the same thing whether it's issued in Darwin or Melbourne — and to crack down on dodgy providers selling worthless qualifications.
