#### 142 Civil proceedings after criminal proceedings The Federal Court or the Federal Circuit and Family Court of Australia (Division 2) must not order a person to pay a pecuniary penalty for contravening a civil penalty provision if the person has been convicted of an offence against this Act constituted by conduct substantially the same as the conduct constituting the contravention.
