Queensland act
**What this law does (mechanics)
Regulates who may exhibit and otherwise deal with live animals shown to the public. It sets out required permissions (authorities), minimum content of those authorities, application procedures, mandatory conditions and enforcement tools. Key authority types are: exhibition licences, interstate exhibitors permits and temporary authorities (s30).
Imposes a general duty on any person who exhibits or deals with an exhibited animal (a "responsible person") to take all reasonable and practical measures to prevent or minimise risks to animal welfare, biosecurity and public safety (the "general exhibition and dealing obligation") (s18). Failure to discharge that duty is an offence (s19).
Requires applicants for licences and permits to supply management plans describing how animals will be exhibited and how significant risks will be prevented or minimised; the chief executive must approve those plans before granting an authority (s37, s58).
Creates mandatory conditions for every authority (for example that animals must be housed in an authorised enclosure, that exhibition notices be displayed, and that sick or injured animals be identified to the public) and permits the chief executive to add special conditions tied to assessed risks (s69, s77).
Establishes an accreditation and private assessment regime: accredited assessors can carry out private inspections and prepare reports to support licence renewals; the chief executive also conducts official assessments and may charge a fee (parts 4 and 5, pts 2–3).

Despite section 13 (2) (a) , the display of an animal at a private event is not an exhibition of the animal for subsection (2) or (3) if the animal is displayed at a regular enclosure site under the licence. Also, despite section 13 (3) , a responsible person for an authorised animal recording the animal’s image is not an exhibition of the animal for subsection (2) or (3) unless the recording is by way of filming for a film or television production in the form of a story, narrative or documentary. In this section— separate occasion , for exhibiting an animal, means— if the animal is exhibited more than once on a particular day to audiences not consisting substantially of the same people—each occasion the animal is exhibited on that day; or otherwise—a particular day on which the animal is exhibited. (sec.75-ssec.1) This section applies to exhibiting an authorised animal (category B) whether identified in an exhibition licence as a particular animal or only as an animal of a species. This Act may be cited as the Exhibited Animals Act 2015 .
Subject to subsection (2) , this Act commences on a day to be fixed by proclamation. If a provision of this Act does not commence before 1 July 2016, it commences on that day. The Acts Interpretation Act 1954 , section 15DA does not apply to this Act. (sec.2-ssec.1) Subject to subsection (2) , this Act commences on a day to be fixed by proclamation. (sec.2-ssec.2) If a provision of this Act does not commence before 1 July 2016, it commences on that day. (sec.2-ssec.3) The Acts Interpretation Act 1954 , section 15DA does not apply to this Act.
The main purpose of this Act is to provide for exhibiting and dealing with exhibited animals. It is also a purpose of this Act to ensure the relevant risks and relevant adverse effects associated with exhibiting and dealing with exhibited animals are prevented or minimised. (sec.3-ssec.1) The main purpose of this Act is to provide for exhibiting and dealing with exhibited animals. (sec.3-ssec.2) It is also a purpose of this Act to ensure the relevant risks and relevant adverse effects associated with exhibiting and dealing with exhibited animals are prevented or minimised.
The purposes of this Act are to be achieved primarily by— imposing a general obligation on persons exhibiting and dealing with exhibited animals to prevent or minimise the relevant risks and relevant adverse effects associated with exhibiting and dealing with exhibited animals; and requiring that authorities be obtained to allow particular animals to be exhibited; and imposing additional obligations on persons exhibiting or dealing with authorised animals under exhibited animal authorities; and providing for monitoring and enforcement of compliance with this Act; and providing for codes of practice relating to a person’s obligations under this Act; and providing for the chief executive to make guidelines about the application of this Act and how a person may comply with obligations imposed under this Act.
Gives inspectors broad monitoring and enforcement powers: entry (consent, warrant, limited powers without warrant in public/business premises or in emergencies), search, take samples, require help and documents, give exhibited animal directions (compliance orders), seize animals/things, and destroy animals where urgent welfare or biosecurity reasons exist (ch.6, esp. ss157–173, 181–197, 203).
Sets out criminal and civil remedies and post-seizure procedures: penalties for non‑compliance, forfeiture, disposal and prohibition orders by courts, recovery of investigation/seizure costs and compensation routes (chs 6–7, ss231–239, 237–238).
Provides internal review and external appeal routes (internal review by chief executive, external review to QCAT or appeal to court) with rules about stays and timing (ch.7, pt.5).
Preserves interactions with other legislation and provides targeted exemptions and transitional provisions (e.g. where other Acts provide authorisation, short-term displays, scientific use, agricultural shows) (s7, s10; transitional ch.9).
Who is affected
Why it matters (policy intent and practical effects)
The Act’s stated purpose is to provide a regulatory framework for exhibiting and dealing with exhibited animals and to prevent or minimise the relevant risks and adverse effects arising from those activities (s3). The law’s core mechanisms to achieve that are mandatory licensing, management plans, codes/guidelines and an inspectorate with powers of entry, seizure and directions (s4, s23, s26, ch.6). These are the explicit levers by which the State moves from a permissive to a managed approach.
Implementation costs and compliance burdens fall mainly on exhibitors and licence/permit applicants: management‑plan preparation, fees, record‑keeping, required inspections (official or private), meeting mandatory conditions (enclosure standards, minimum exhibition periods for some categories), insurance requirements and possible special conditions (ss51, 37, 65, 69, 77, 86, 105). Those are concrete, recurring costs.
The chief executive and inspectors have wide discretionary powers: to approve management plans, impose special conditions, require further information, grant temporary authorities, give exhibited animal directions and exercise entry/seizure powers (e.g. ss54–57, 63, 77, 184, 181, 192). That concentrates decision authority in the administration and creates execution risk — outcomes (timing, conditions) will depend on administrative practice and resourcing.
Enforcement incentives are structured toward preventing animal welfare harms, biosecurity events and public‑safety incidents: inspectors may seize animals, require actions, and the State can recover seizure/investigation costs (ss192, 194–197, 237–238). For regulated entities this creates strong incentives to comply with management plans, to maintain records (s86), and to use accreditation/private assessments to reduce regulatory friction (pts 4–3).
The Act affects private enterprise choices and operational models. Examples:
Trade‑offs and implementation risks:
Explicitly-stated purpose claims and testing them against costs/incentives
Claim: "Prevent or minimise risks associated with exhibiting and dealing with animals" (s3).
Claim: "Provide monitoring and enforcement" (s4(d)).
