Division 3—Person search warrants1
160 Director-General may request person search warrants2
(1) The Director-General may request the Attorney-General to issue a3
warrant in respect of a particular person.4
(2) The request must specify the following:5
(a) the name, or a description, of the person;6
(b) the facts and other grounds on which the Director-General7
considers it necessary that the warrant should be issued;8
(c) the kinds of documents or things that the Director-General9
has reasonable grounds for believing:10
(i) may be found if the warrant is executed; and11
(ii) if accessed by the ACIC, will assist the ACIC to obtain12
intelligence in accordance with this Act in respect of a13
matter.14
(3) The request must be in writing unless the Director-General15
considers it necessary, because of urgent circumstances, to make16
the request orally.17
(4) If the Director-General makes the request orally, the18
Director-General must:19
(a) provide all information required to be provided in a written20
request; and21
(b) as soon as practicable, forward to the Attorney-General a22
written record of the request.23
