(b) the Attorney-General is satisfied there are reasonable grounds1
for suspecting that the person has in their possession, or will2
within the next 72 hours have in their possession, a document3
or thing; and4
(c) the Attorney-General is satisfied there are reasonable grounds5
for believing that access by the ACIC to the document or6
thing will assist the ACIC to obtain intelligence in7
accordance with this Act in respect of a matter (the serious8
and organised crime matter); and9
(d) the Attorney-General is satisfied that subsection (2) or (3)10
applies.11
(2) This subsection applies if:12
(a) a summons or notice to produce has been issued requiring the13
person to produce the document or thing; and14
(b) there are reasonable grounds for believing that any of the15
following might be concealed, lost, mutilated or destroyed:16
(i) the document;17
(ii) the thing;18
(iii) information or a document held in or accessible from19
the thing.20
(3) This subsection applies if there are reasonable grounds for21
believing that if a summons or notice to produce were issued to22
require the person to produce the document or thing, any of the23
following might be concealed, lost, mutilated or destroyed:24
(a) the document;25
(b) the thing;26
(c) information or a document held in or accessible from the27
thing.28
(4) The warrant is a person search warrant.29
Notice and record of decision30
(5) As soon as practicable after making a decision in relation to the31
request for the warrant, the Attorney-General must:32
(a) if the Attorney-General decides to issue a warrant:33

(i) cause the Director-General to be informed of the1
issuance of the warrant; and2
(ii) cause the warrant to be given to the Director-General;3
and4
(b) record the decision in writing; and5
(c) cause the record to be given to the Director-General.6
