196 Requirement to make annual recommendation about charges11 (1) For the purposes of paragraph 195(c), before the end of each12 financial year, the Committee must recommend to the Minister in13 writing that the Minister either:14 (a) vary the legislative instrument under subsection 7(1) of the15 Charges Act in accordance with the recommendation; or16 (b) not vary the legislative instrument made under17 subsection 7(1) of the Charges Act.18 (2) In making the recommendation, the Committee:19 (a) must have regard to the principle that the charges and other20 fees imposed for national policing information services21 should cover the costs to the ACIC of providing national22 policing information systems and services (including23 nationally coordinated criminal history check services); and24 (b) may have regard to any other matter the Committee considers25 relevant.26 (3) If the Committee recommends that the Minister vary the27 instrument, the recommendation must set out the matters28 considered by the Committee.29
