179 Offence—failure to comply with assistance order16
A person commits an offence if:17
(a) the person is subject to an assistance order; and18
(b) the person is capable of complying with the order; and19
(c) the person engages in conduct; and20
(d) the person’s conduct contravenes the order.21
Penalty: Imprisonment for 5 years or 300 penalty units, or both.22

180 Simplified outline of this Part4
The ACIC is the administrator of the national policing information5
system and has specific functions in relation to the system.6
A person or body who provides national policing information:7
(a) is the contributor of the information; and8
(b) continues to be responsible for the information.9
A person or body who accesses national policing information is a10
user of the information.11
A law of a State, the Australian Capital Territory or the Northern12
Territory may confer a duty, function or power that relates to13
national policing information functions on the ACIC, the14
Director-General or an ACIC staff member.15
The Director-General may approve a person or body as an16
accredited body for the purposes of requesting and receiving17
nationally coordinated criminal history check services on behalf of18
consenting applicants.19
The ACIC may communicate information from nationally20
coordinated criminal history check services subject to certain21
conditions.22
The functions of the National Policing Information Committee23
include advising about priorities for national policing information24
systems and services and making recommendations to the Minister25
about charges for providing nationally coordinated criminal history26
check services.27

Charges, fees and other amounts received by the ACIC relating to1
national policing information functions are credited to the National2
Policing Information Systems and Services Special Account.3

Division 2—The national policing information system1
181 The national policing information system2
(1) The Director-General may, by writing, declare that a system for3
correlating, providing access to, or facilitating the exchange of,4
information is part of the national policing information system.5
(2) A declaration made under subsection (1) is a legislative instrument,6
but section 42 (disallowance) of the Legislation Act 2003 does not7
apply to the declaration.8
Meaning of national policing information9
(3) National policing information:10
(a) is information that can be accessed through the national11
policing information system; and12
(b) includes information that has been provided to the ACIC13
solely for the purposes of being made available through the14
national policing information system.15
182 The administrator16
(1) The ACIC is the administrator of the national policing information17
system.18
(2) The functions of the ACIC as administrator of the system include19
the following:20
(a) developing, supporting and maintaining the system, including21
by scoping, enhancing and improving the system;22
(b) providing assistance to contributors and users, including in23
relation to accessing and using the system;24
(c) restricting or preventing access to national policing25
information in accordance with instructions of contributors;26
(d) ensuring that users of the system are notified of restrictions27
or conditions on the use of national policing information in28
accordance with the instructions of contributors;29

(e) providing ancillary services to facilitate the operation and use1
of the system.2
