208 Australian Criminal Intelligence Commission Bill 2026 No. , 2026
(a) without meeting, a majority of Committee members indicate1
agreement with the decision; and2
(b) that agreement is indicated in accordance with the method3
determined by the Committee under subsection (2); and4
(c) all of the Committee members were informed of the5
proposed decision, or reasonable efforts were made to inform6
all the members of the proposed decision.7
(2) Subsection (1) applies only if the Committee:8
(a) has determined that it may make decisions of that kind9
without meeting; and10
(b) has determined the method by which members are to indicate11
agreement with proposed decisions.12
(3) The Committee must keep a record of decisions made in13
accordance with this section.14
Substitute members15
(4) If a person has been nominated under subsection 194(6) in relation16
to a proposed decision, or a nomination under subsection 194(4) is17
in force in relation to the person, then subsection (1) of this section18
applies as though a reference to a Committee member were a19
reference to the person.20
