What it does
The Personal Injury Commission Rules 2021 (the Rules) constitute a comprehensive procedural code governing the conduct of “applicable proceedings” before the Personal Injury Commission (PIC) established under the Personal Injury Commission Act 2020 (PIC Act). Rule 3 expressly states that their object is to give effect to the guiding principle in s 42 of the PIC Act: the just, quick and cost-effective resolution of the real issues in dispute.
Part 1 contains introductory provisions (rules 1–4) naming the Rules, fixing commencement on the “establishment day”, stating the object, and incorporating definitions from the Dictionary, the PIC Act, the Interpretation Act 1987 and enabling legislation. Rule 4(2) provides that words used in relation to proceedings under enabling legislation carry the same meaning unless the Rules or context require otherwise.
Part 2 (rules 5–10) defines the five categories of applicable proceedings—Commission proceedings, mediation proceedings, medical assessment proceedings, merit review proceedings and panel review proceedings (rule 5)—and confers broad dispensing powers on the Commission and the President (rule 6). Where the Rules are silent, the Commission or President may give directions (rule 7). Non-compliance is treated as an irregularity rather than a nullity (rule 8). Non-presidential members and merit reviewers may make any procedural order the President could make, including striking out proceedings (rule 9). The Rules prevail over procedural directions to the extent of inconsistency (rule 10).
Part 3 (rules 11–15) establishes the Registry under the principal registrar’s control (rule 11), prescribes the form and use of the Commission’s seal (rule 12), deems all presidential and divisional-head functions delegable (rule 13), requires a public register of delegations (rule 14), and strictly regulates access to the Electronic Case Management (ECM) system (rule 15). Only parties, their Australian legal practitioners or authorised agents may use the ECM system unless a protocol permits otherwise.
