35 Expert witnesses
(1) Rule 34 applies to an expert witness in the same way as it applies to any other witness and any expert’s report prepared by the expert witness constitutes a written statement of the evidence to be given by the witness for the purposes of rule 34(1)(b).
(2) A party proposing to call a witness to give evidence as an expert witness has a duty to ensure the witness is aware of and adheres to any procedural direction concerning the use of expert witnesses.
