#### 88 Response to application for mediation 88 Response to application for mediation > > (1) A defendant served with an application for mediation of a claim must, within 21 days of registration of the application, lodge— > > > > > (a) a response to the application, and > > > > > (b) a copy of the pre-filing defence served by the defendant in accordance with section 316(1)(b) of the 1998 Act, and > > > > > (c) copies of the information and documents served with the pre-filing defence as required by rule 86. > > > (2) The response to the application must indicate whether or not the defendant will decline, under section 318A(3) of the 1998 Act, to participate in mediation of the claim. > > > (3) The defendant must, within 7 days of lodging the response, serve the response on the claimant.
