#### 100 Schedule of damages 100 Schedule of damages > > (1) If, in proceedings for a claim under the MAC Act or the MAI Act, the amount of damages is in dispute, the claimant must include in the application to commence proceedings a schedule of damages containing full particulars of the amount claimed. > > > (2) If a party wishes to dispute the accuracy of a matter in the schedule of damages, the party must lodge and serve on the other parties a schedule of damages containing full particulars of the party’s allegations of the damages. > > > (3) The schedule of damages is to be lodged and served with the first document lodged and served by the party in the proceedings, in addition to the documents that must be lodged and served under Division 7.2. > > > (4) A matter not disputed by a party under subrule (2) is deemed to be admitted by the party. > > > (5) The claimant may lodge and serve a final schedule of damages at least 7 days before the assessment hearing. > > **rule 100:** Am 2024 (587), Sch 1\[1\]; 2025 (708), Sch 1\[1\].
