act

Plain English Summary

6/10 complexity

Mechanically, the Act creates and governs the Library Board of Queensland and the State Librarian, sets their powers, governance, planning and Ministerial oversight, and imposes a legal‑deposit duty on publishers to supply copies to the State and Parliamentary libraries.

It affects board members, librarians, local governments running library facilities and publishers; it matters because it allocates decision‑making and funding responsibilities, creates compliance duties (planning, reporting, deposit, inspections) and gives the board statutory powers over property and operations.

What it does

This Act creates and governs the Library Board of Queensland, its membership, the office of State librarian, and the State Library, and sets out the board’s functions, powers, accountability obligations and several operational offences and administrative modalities. The mechanics are: continue the statutory body called the Library Board of Queensland (s 4), give it corporate status and capacity to sue and be sued (s 5), and specify that the board represents the State (s 6). The board’s functions are listed in s 20, including control and management of the State Library, coordination and support for public libraries throughout Queensland, collection and preservation of Queensland-related materials, provision of advice to local government and other authorities, and performance of incidental functions and functions given in writing by the Minister (s 20(1)(a)-(l)). The Act sets out the legal capacity of the board to act like an individual, for example to enter contracts, hold and dispose of property, appoint agents and to charge for goods and services (s 22).

Governance mechanics are prescribed. The Governor in Council appoints members (s 7) and a chairperson (s 10), members serve up to three year terms (s 11), and the board operates by majority vote subject to quorum rules (ss 31-37). The State librarian is appointed by the Governor in Council for up to five years (s 13), must manage the board under the members (s 14), and is an employee of the board subject to conditions (s 13B). The board and the State librarian may delegate powers to appropriately qualified employees, including employees performing work under a work performance arrangement (ss 17, 40, 40A).

The Minister retains direct control levers. The board is subject to written directions from the Minister in exercising its powers (s 23). Detailed planning and funding interaction is driven by mandatory strategic and operational plans produced by the board and agreed by the Minister, with specified timelines, content and a role for the Treasurer on funding matters (ss 43-50, 48). The board must keep the Minister informed and permit the Minister or authorised persons to investigate and report on board matters (ss 51-52). The Act links the board to Queensland’s financial and statutory-body frameworks, for example by reference to the Financial Accountability Act 2009 and the Statutory Bodies Financial Arrangements Act 1982 (s 77, definitions at s 2).
