What it does
This Act establishes the Batchelor Institute of Indigenous Tertiary Education as a corporate body and sets out its structure, governance, functions, powers, financial arrangements, and transitional arrangements from the former Batchelor College. Mechanically, the Act does the following.
- Creates the Institute as a body corporate with a common seal and perpetual succession (s 4(1)-(3)).
- Replaces Batchelor College and preserves its corporate identity, assets, liabilities, contracts and proceedings as those of the Institute on commencement (s 5; Schedule cl 3).
- Constitutes the governing Council to conduct the Institute’s affairs and specifies its primary functions and powers including approving mission, overseeing academic activity, approving budgets and commercial activities, and monitoring risk and accountability systems (ss 9-10).
- Specifies Council composition and appointment and election processes, including Ministerial and Administrator roles, CDU nomination, staff and student election slots, the Director and an Education Agency CEO nominee (s 11; ss 12-16).
- Establishes an Institute Advisory Board made up predominantly of appointed indigenous members to advise on cultural and social issues and systemic changes affecting indigenous students, and requires the Council to fund the Board (ss 24, 24A, 24B(5)).
- Creates a range of administrative rules: by-laws, rules and codes of conduct; empowers the Council to make them and to impose penalties under by-laws up to 8 penalty units (ss 49-52; s 49(2)(zk), (zm); s 51(3)).
- Sets out financial governance: accounts, audit by Auditor-General, annual report to Minister, budget adoption requirements, Treasurer oversight on investments and loans, and an express exclusion of the Financial Management Act 1995 (ss 35-46; s 48; s 41(1)-(3); s 42(7)).
