What it does
The Unit Titles Act 2001 (ACT) establishes the legal framework for creating, registering and managing unit title developments in the Australian Capital Territory. It is the ACT's equivalent of strata title legislation in other jurisdictions, adapted for the ACT's unique land tenure system in which land is generally held under Crown lease (leasehold) rather than freehold.
The Act governs the subdivision of a parcel of land into individual units and common property, the creation and registration of units plans, and subsequent amendments, cancellations and changes to those plans. It creates the physical framework for unit title ownership; the ongoing management of the owners corporation and the day-to-day operation of common property is separately addressed by the Unit Titles (Management) Act 2011.
