23 Notice of approval of unit title applications
(1) If the territory planning authority approves a unit title application for
a parcel, the authority must give the lessee of the parcel—
(a) written notice of approval including—
(i) if the application provides for a staged development—
a copy of the development statement, signed by the
authority, as amended (if at all) under section 22; and
(ii) particulars of any security required under section 24; and
(b) a schedule setting out, for each unit—
(i) the rent to be reserved under the lease; and
(ii) the provisions subject to which the lease is to be held
including the permitted uses and—
(A) whether the unit is restricted to residential use only;
and
(B) if the unit is not restricted to residential use only—the
full list of potential uses; and
(C) any conditions on a particular use; and
(c) a schedule setting out the provisions subject to which the lease
of the common property is to be held.
(2) The rent reserved under the lease of a unit as indicated in the schedule
mentioned in subsection (1) (b) is the rent for that unit (including any
unit subsidiary annexed to the unit) indicated in the application or as
decided by the territory planning authority under section 21 (Unit title
applications—reasonable rent).
