173A Internal review notices
(1) If the territory planning authority makes an internally reviewable
decision, the authority must give an internal review notice only to
each person mentioned in schedule 1, column 4 in relation to the
decision.
Note Section 174 gives a person who is given an internal review notice the
right to object to the internally reviewable decision (unless the person
was the applicant for the decision, and the decision was made in the
applicant’s favour).
(2) However, the territory planning authority is not required to give an
internal review notice to a person with an interest in a parcel, or an
interested non-voter, in relation to a decision if the authority is not,
and could not reasonably be, aware of the person’s interest because
of the process of reaching the decision.
(3) An internal review notice given to a person in relation to a decision
must include a statement to the effect that the person may not object
to the decision if—
(a) the person applied for the decision; and
(b) the decision was made in accordance with the application.
