What it does
The Road Management Act 2004 (Vic) reforms the law relating to road management in Victoria. Its primary object (section 4(1)) is to establish a coordinated management system that promotes a road network operating as part of an integrated and sustainable transport system consistent with the transport system objectives under the Transport Integration Act 2010.
The Act replaces earlier fragmented road law with a comprehensive statutory framework. It allocates management responsibility between road authorities by road classification, requires road management plans and Codes of Practice, sets out road authority powers and duties, coordinates the placement of infrastructure on road reserves, and substantially modifies the civil liability of road authorities through Part 6.
The Act applies to roads across Victoria, including public highways, arterial roads, controlled access roads, and private roads. It covers Transport for Victoria (successor to VicRoads) as the State road authority, local councils as local road authorities, and private toll road corporations operating under project-specific legislation.
