121 Agreement to conduct additional works (1) A road authority may enter into an agreement with the owner or occupier of land adjacent to a road or the developer of nearby land or any other person for the performance of works on a road which may benefit that person. (2) An agreement under this section may include provisions relating to— (a) payment for the conduct of the works; (b) future arrangements in respect of ongoing maintenance and risk allocation. (3) An agreement under this section is enforceable. (4) If a road authority is the responsible authority under the **Planning and Environment Act 1987**, provisions of an agreement for the purposes of this section may be incorporated into an agreement under section 173 of that Act.
