What it does
The Design and Building Practitioners Regulation 2021 (the Regulation) is subordinate legislation made under the Design and Building Practitioners Act 2020 (the Act). Its core function is to operationalise a statutory scheme of registration, declaration and lodgment that applies to “regulated designs” and “building work” for class 2, 3 and 9c buildings (and mixed-use buildings containing those classes).
At its heart the Regulation prescribes the precise form, content and timing of three types of statutory declaration:

Design compliance declarations (Act s 8, Reg cl 8–11). A registered design practitioner must declare that a regulated design complies with the Building Code of Australia (BCA). The declaration must address performance solutions (cl 5), fire-resisting elements and penetrations (cl 6), integration of vertical transportation products (cl 7), and coordination with other designs (cl 8). Additional mandatory statements concern building products, specialist advice and, for vertical-transportation designs, compliance with AS 1735 (cl 9).

Principal compliance declarations (Act s 12, Reg cl 10, 21). A registered principal design practitioner must declare that all construction-issued regulated designs for a project have been the subject of design compliance declarations by appropriately registered practitioners. Exemptions from certain Act s 8(2) matters are available when the declaration is provided early (cl 10).

Building compliance declarations (Act s 17, Reg cl 18, 19A, 26). The registered building practitioner must declare that the completed building accords with the lodged regulated designs (subject to permitted variations recorded in a variation statement under cl 27). The declaration must be accompanied by a contractor document, fire-safety certificate and any additional details not reflected in the construction-issued designs (cl 18(2)).
