- The application of laws made under s 122 affecting property cannot always be confined to property located within a territory. There are many species of incorporeal property the situs of which may not be fixed or readily ascertainable[183].
- The power conferred by s 122 on the Commonwealth Parliament to make laws for the Territories which also affect the States and which might include acquisition of property within a State, eg for the establishment of a tourist bureau for a territory[184]. Another example might be the establishment of a transport terminal.
