What it does
The Road Transport (Vehicle Registration) Regulation 2017 (the Regulation) provides the detailed, operational machinery for the registration of all registrable vehicles in New South Wales. At its core, it translates the high-level powers in the Road Transport Act 2013 (the Act) into enforceable, day-to-day rules. The Regulation is divided into 11 Parts that collectively govern the entire lifecycle of a vehicle’s registration status.
Part 1 contains preliminary provisions, including the Regulation’s name, commencement (1 September 2017), definitions (cl 3), and rules for applications made through agents (cl 4). It repeals the 2007 Regulation and aligns with national uniform legislation reproduced in Schedule 2 (the Light Vehicle Standards Rules).
Part 2 establishes the registration process. Division 1 sets eligibility criteria: individuals must be at least 16 years old (cl 5), and vehicles must comply with applicable vehicle standards, third-party insurance, duty requirements, and not be subject to cancellation or recall (cl 6). Division 2 details the application process—approved forms (cl 8), supporting evidence including for written-off vehicles (cl 9), lodgment and payment (cl 10), nomination of registration periods (cl 11), and determination by Transport for NSW (cl 12). Conditional registration is available for non-compliant vehicles (cl 13), with safety risks explicitly weighed.
Division 3 requires Transport for NSW to maintain the Register, recording operator details, vehicle identifiers, garage address, expiry, conditions, GVM/GCM, nominated configuration for heavy vehicles, and insurer information (cl 14). Changes in description or configuration must be recorded, and the Register must cover the previous 24 months. Dealings may be restricted.
Division 4 mandates certificates of registration containing prescribed particulars (cl 15) and provides for replacement certificates (cl 17). Division 5 governs number-plates: assignment of distinguishing numbers (cl 20), special and auxiliary plates (cll 21–22), alteration of numbers or designs (cll 23–24), display requirements with diagrams (cl 25), reservation, transfer and replacement (cll 26–28), damaged or lost plates (cll 29–31), return obligations (cl 32), concession arrangements (cl 33), and offences for unlawful possession (cl 34).
