What it does
The Health Insurance Act 1973 establishes Medicare benefit entitlement for professional services rendered in Australia to eligible persons, calculated by reference to prescribed tables of fees and items (ss 9, 10). Part I sets out commencement, definitions and ministerial powers to prescribe tables, recognise specialists, accredit podiatrists and treat unspecified services as professional services (ss 1-4B, 3AAA-3GC). Part IIA regulates pathology through approved pathology practitioner and authority undertakings, accredited laboratories, specimen collection centres and request retention (ss 23DC-23DNL). Part IIB requires written requests for R-type diagnostic imaging services, registration of premises and bases on the Diagnostic Imaging Register, and accreditation schemes (ss 16B, 23DZK-23DZZIAG). Part IIC mirrors registration requirements for radiation oncology premises and bases (ss 23DZZJ-23DZZZH). Part IIBA prohibits non-permitted benefits and threats intended to induce pathology or diagnostic imaging requests (ss 23DZZIA-23DZZIU). Part VAA creates the Professional Services Review Scheme to examine inappropriate practice (ss 79A-106ZR). Parts IV, IVAA and VA authorise health program grants, former Health and Hospitals Fund payments and the National Rural Health Commissioner. Section 20AA voids PPSA security interests in assigned benefits. Part II (ss 9-10ADA) establishes Medicare benefits payable for professional services rendered in Australia to eligible persons, calculated by reference to the general medical services table, pathology services table and diagnostic imaging services table. Part IIB (ss 16B-16G) and Part IIA (ss 16A, 23DC-23DL) impose request, registration and accreditation requirements for R-type diagnostic imaging services and pathology services. Part VAA (ss 79A-106ZR) creates the Professional Services Review Scheme to review and investigate provision of services for inappropriate practice, with outcomes including agreements under s 92, Committee referrals under s 93 and determinations under s 106U. Parts IIC, IV, IVAA and VA address radiation oncology registration, health program grants and the National Rural Health Commissioner.
