The Act affects eligible persons incurring medical expenses, medical practitioners, dental practitioners, optometrists, participating midwives and nurse practitioners, approved pathology practitioners and authorities, proprietors of diagnostic imaging and radiation oncology premises and bases, requesters and providers of pathology or diagnostic imaging services, connected persons (relatives, officers, related bodies corporate, trustees, partners, employers/employees, s 23DZZIJ), billing agents, and executive officers of bodies corporate. It also affects organisations receiving health program grants and the National Rural Health Commissioner’s stakeholders in rural, regional and remote health. Eligible persons receiving services, medical practitioners, approved pathology practitioners and authorities (ss 23DC, 23DF), diagnostic imaging premises and mobile bases (s 16D), radiation oncology premises (s 16F), medical entrepreneurs, families registered under s 10AA, and persons under review in the Professional Services Review Scheme (ss 86, 88A). The Director, Committees, Determining Authority and Chief Executive Medicare administer the scheme. Approved organisations receive health program grants (ss 42-46).

Eligible persons are entitled to benefits at 75 per cent (hospital), 85 per cent or 100 per cent of the Schedule fee, subject to the greatest permissible gap and safety-net thresholds (ss 10, 10AC-10ADA). Practitioners and authorities must give undertakings, satisfy fit-and-proper tests, retain requests and records for two years, produce them on demand, and notify primary-information changes within 28 days (ss 23DK, 23DKA, 23DR, 23DS, 23DZV). Proprietors must register premises/bases, display approval notices, inform patients where benefits are not payable, and maintain accreditation (ss 23DZZF, 23DNK, 23DZZIAE). Giving false or misleading answers or documents attracts imprisonment for 12 months (ss 106ZPO, 106ZPP). The Determining Authority may direct reprimand, repayment of benefits, disqualification up to five years (or full disqualification) in final determinations (s 106U). Breaches of pathology undertakings may be referred to the Medicare Participation Review Committee (s 23DL). Unpaid amounts are recoverable as debts due to the Commonwealth.

The Act incorporates definitions from the National Health Act 1953 (s 3(1A)), applies Chapter 2 of the Criminal Code to offences (s 7B), and operates subject to State and Territory laws on service authorisation (s 16C).
