#### 23DZZIC Crown to be bound (1) This Part binds the Crown in each of its capacities. (2) Nothing in this Part has the effect of making the Commonwealth, or a State or Territory: (a) liable to be prosecuted for an offence or to be subject to civil proceedings for a contravention of a civil penalty provision; or (b) liable to pay any fine or penalty under this Part. (3) Subsection (2) does not prevent the Commonwealth, or a State or Territory, from being subject to proceedings for an injunction to restrain the Crown in right of the Commonwealth, a State or a Territory from engaging in conduct that contravenes this Part. (4) To avoid doubt, this section does not imply that the Crown is or is not bound by any other Part of this Act.
