#### 106ZPH Acting appointments (1) The Minister may appoint a person to act in a particular office of member of the Authority: (a) during a vacancy in that office (whether or not an appointment has previously been made to the office); or (b) during any period or during all periods when the member is absent from duty or from Australia or is, for any other reason, unable to perform the duties of the office. > Note: For rules that apply to acting appointments, see section 33A of the Acts Interpretation Act 1901. (2) The Minister may not appoint a person to act in the office of Chair of the Authority unless the person is a medical practitioner. (3) The Minister must not appoint a person to act in an office of a member (the relevant member) of the Authority referred to in paragraph 106ZPA(1)(c) unless the person is a practitioner of the same kind as the relevant member. (4) Subsection 106ZPB(3) applies to an appointment of a person under this section to act in the office of a member of the Authority in the same way as it applies to an appointment of a person to the office under subsection 106ZPB(1).
