What it does
The Water Industry Competition Act 2006 (NSW) establishes a licensing and approval framework to enable private sector competition in the New South Wales water and sewerage industry. Its objects (section 2A, inserted in 2021) are: to protect public health, safety and the environment; to protect the interests of consumers in quality, reliability and price; to facilitate efficient and sustainable provision of water and sewerage services; to promote sustainable use of resources; and to facilitate competition to encourage innovation and improved efficiency.
The Act addresses a market traditionally dominated by public water utilities such as Sydney Water, Hunter Water, and Water NSW. It creates pathways for private operators and retailers to enter the market under regulatory supervision, subject to approvals and licences from IPART and the Minister. The Act has been significantly amended, most recently by the Water Industry Competition Amendment Act 2021 (No. 26 of 2021), which restructured the approval and licence framework and added new provisions for consumer protection.
