#### 32 Applications for binding non-coverage declaration 32 Applications for binding non-coverage declaration > > (1) An application for a binding non-coverage declaration for an infrastructure service— > > > > > (a) may only be made by or on behalf of the service provider for that service, and > > > > > (b) may not be made after the water industry infrastructure by means of which the service is to be provided has been commissioned. > > > (2) A binding non-coverage application— > > > > > (a) must be in such form as the Minister may approve, and > > > > > (b) must be accompanied by such fee as the Minister may determine, and > > > > > (c) must be lodged at the office of IPART.
