What it does
The Oaths Act 1867 (Qld) is Queensland's principal legislation governing the form and administration of oaths, affirmations, affidavits, and declarations, and the witnessing of legal documents. One of the oldest Acts still in force in Queensland, it has been substantially updated in recent years to accommodate electronic signing and remote witnessing by audio visual link. The most significant amendments were made in 2021 (Act No. 23 of 2021) and 2023 (Act No. 23 of 2023), which modernised the framework for executing and witnessing documents in digital environments.
The Act governs the circumstances in which oaths and affirmations may be taken and administered, the requirements for valid affidavits and statutory declarations, and the rules for witnessing documents, including remotely via video conferencing.
