The person or body for a court or tribunal who has the power to make rules of court or practice directions regulating the practice and procedure of the court or tribunal may make, give, issue or approve a rule or practice direction that states an accepted method for electronically signing an affidavit or a declaration to be filed or admitted into evidence in a proceeding in the court or tribunal.
The person or body for the court or tribunal must, when making, giving, issuing or approving a rule or practice direction under subsection (2) , consider the need to ensure consistency of the rule or practice direction with the rules or practice directions of other courts and tribunals.
If a rule or practice direction made, given, issued or approved under subsection (2) is inconsistent with a regulation made under subsection (1) , the regulation prevails to the extent of the inconsistency.
