Higher Education Funding Act 1988

What is this law?

This Act is the foundational law that governed how the Australian federal government funded universities and other higher education institutions from 1989 to 2004. It has largely been superseded by newer legislation, but its provisions (especially around student debt) remain legally relevant for that historical period.

Who does it affect?

• Students at Australian universities and colleges — particularly through the Higher Education Contribution Scheme (HECS), which is the original version of what most people now know as HELP debt. This was the law that introduced the concept of deferred student fees that you repay through the tax system once your income reaches a threshold.
• Universities and colleges listed in the Act (Table A and Table B) — covering virtually every major Australian university, plus many smaller colleges (including religious colleges like Moore Theological College and Avondale College).
• Overseas students — they were excluded from HECS and charged separate fees.
• Researchers and research bodies — the Act provided specific grants for research programs and research training.

What does it actually do?

1. Funds universities: The government pays operating grants to universities to cover teaching, research, and running costs. The amounts are fixed in the Act for each year (e.g., over $3 billion per year by the mid-1990s).
