Introduction
- The appellants, in proceedings AP 17/04738, are Mr Rekrut and Ms Scott (the owners) and Champion Homes Sales Pty Ltd (the builder) is the respondent. In proceedings AP 17/09469, the appellant is the builder and the owners are the respondents.
- In 2009, the builder contracted with the owners to carry out certain home building work.
- On 23 December 2013, the owners made claims against the builder under the Home Building Act 1989 (NSW) (HB Act) for damages for alleged incomplete or defective building work and contractual damages including liquidated damages. They lodged their application in the former Consumer, Trader and Tenancy Tribunal (CTTT). Under the transitional provisions in cl 7 of Sch 1 to the Civil and Administrative Tribunal Act 2013 (NSW) (the NCAT Act), this Tribunal was empowered to hear and determine those proceedings.
- The hearing at first instance took place over many months, on 18 and 19 August and 20 October 2015 and 7 June 2016. After this, the parties were permitted to file written submissions. The period for filing those submissions did not close until 20 August 2016.
- On 23 December 2016, the Tribunal at first instance ordered that the builder pay to the owners $63,586.59, as well as making other ancillary orders and providing its reasons for decision.
- On 31 January 2017, the owners lodged an appeal (AP 17/04738) against the Tribunal's decision. The builder also lodged an appeal (AP 17/09469) but not until 27 February 2017.
- For the reasons set out below, we have determined that both appeals should be allowed in part and otherwise dismissed.
