Solicitors: Lindsay Taylor Lawyers (Respondent) File Number(s): AP 19/46636 Publication restriction: Nil Decision under appeal Court or tribunal: Civil and Administrative Tribunal of New South Wales Jurisdiction: Administrative and Equal Opportunity Division Citation: [2019] NSWCATAD 196 Date of Decision: 19 September 2019 Before: A Scahill, Senior Member File Number(s): 2019/00054095
REASONS FOR DECISION
- This matter involves the respondent's refusal to grant an ABH firearms licence to the appellant. The appellant applied in early 2018 to the respondent for the firearms licence and stated her genuine reason to be "Sport/target shooting and Recreational hunting/vermin control".
- The respondent refused to approve the application and grant the licence, stating that approval would be against the public interest. The appellant sought internal review which affirmed the respondent's decision. The appellant then sought administrative review in the Administrative and Equal Opportunity Division of the Tribunal, which also affirmed the respondent's decision. She has appealed from the Tribunal's decision of 19 September 2019 (the Decision)..
- There is an appeal as of right on an error of law to this Appeal Panel and on other grounds with the leave of the Panel: Civil and Administrative Tribunal Act 2013 (NSW) (NCAT Act), s 80(2).
