Judgment (15 paragraphs)
Introduction
- This is an application by Ms Vanessa Oliver ("the Applicant") for review of a decision of a delegate of the Commissioner of Police ("the Respondent" or "the Commissioner"). The decision was to revoke the Applicant's category AB firearms licence under the Firearms Act 1996 ("the Act").
- The decision was affirmed on internal review and the Applicant has applied to the Tribunal for external review.
- The Respondent considers that: 1. the Applicant may not personally exercise continuous and responsible control over firearms because of her domestic circumstances; and 2. it is not in the public interest for the Applicant to continue to hold the licence.
Issues for determination?
- The issue to be determined is whether the correct and preferable decision is to revoke the Applicant's firearms licence. This requires consideration of whether: 1. there is reasonable cause to believe that the Applicant may not personally exercise continuous and responsible control over firearms due to her lifestyle; and 2. it is contrary to the public interest for the applicant to hold a firearms licence.
