Overview
- Mr Elley has appealed from a decision of the Tribunal affirming a decision of the Commissioner of Police to refuse to issue him with a firearms licence. The Commissioner made that decision on two bases. First, she was not satisfied that Mr Elley is a "fit and proper person and can be trusted to have possession of firearms without danger to public safety or to the peace". Secondly, the Commissioner refused Mr Elley's application because she considered "that issuing the licence would be contrary to the public interest". Those grounds for refusal are in s 11(3)(a) and s 11(7) of the Firearms Act 1996 (NSW).
- The grounds of appeal relate to material tendered by the Commissioner of Police in a confidential exhibit (the Confidential Material). That material was not shown to Mr Elley or his lawyer. The parts of the hearing relating to the Confidential Material were conducted in their absence and in the absence of the public.
