What it does
This Act confers additional functions and powers on the Victorian Plantations Corporation (the Corporation), a State body established under the State Owned Enterprises Act 1992, and makes further provision for the management of plantations (section 1). The Act vests substantial tracts of Crown land in the Corporation for plantation purposes, provides a framework for the grant of perpetual plantation licences over vested land, and establishes a dedicated register for those licences. Part 3 sets out the mechanics of vesting: by force of the Act, specified land vests in the Corporation, ceases to be subject to reservations under the Crown Land (Reserves) Act 1978, ceases to be reserved forest, and (except as otherwise provided) ceases to be subject to the Forests Act 1958 (section 9). The Act also empowers the Corporation to surrender or transfer land, to acquire interests in land without compulsory process, to dispose of freehold land, and to grant leases, licences and permits over vested land (sections 16-20). Part 3A, inserted in 1998, allows the Corporation to grant perpetual licences over vested land for forestry business, including the establishment and management of timber plantations and the taking of forest produce (section 27B). A registrar of plantation licences must be appointed, and a register maintained (sections 27K-27L). No compensation is payable by the Crown or the Corporation for the vesting or divesting of land, the revocation of a reservation, or the closure of a road under the Act (section 27), and the jurisdiction of the Supreme Court is limited to prevent it awarding compensation in respect of those matters (section 33). Part 5, also inserted in 1998, provides for the transfer of property, rights, liabilities and staff of the Corporation to other persons, including the preparation of allocation statements and the automatic vesting of property on a relevant date fixed by the Treasurer (sections 34-51). The Act also applies provisions of the Forests Act 1958 to freehold land and vested land, gives the Corporation powers under the Conservation, Forests and Lands Act 1987, and regulates access through Crown land, vested land and managed land (sections 10-13, 23, 32).
